초록
The rapid advancement of deepfake technology, which utilizes deep learning techniques such as Generative Adversarial Networks (GANs) to create highly realistic synthetic images, videos, and audio, has presented unprecedented legal challenges across various domains. While existing legal discourse has primarily focused on issues such as non-consensual pornographic content, political disinformation, and defamation, relatively little scholarly attention has been paid to the legal implications arising when third parties create unauthorized deepfake commercial advertisements without the consent of the celebrities depicted therein or the trademark holders involved.
 This study systematically examines the legal issues arising from unauthorized deepfake commercial advertisements produced by third parties, with particular focus on the situation where a celebrity serving as an advertising model for Company A is depicted in a deepfake advertisement promoting the products of a competing Company B. The research conducts a doctrinal analysis of liability allocation and remedial measures, centering on the benefits and detriments accruing to the trademark holder and the applicability of unjust
