초록

As a general principle under international public law and the law of international organizations, there are basically two ways by which national and international legal personality can be obtained by an international organization. Firstly, through the conclusion of one or more explicit provision(s) to this end in the constituent treaty and recognition of this legal personality by third states and/or other international organizations. Secondly, by implication. The existence of implied legal personality can be derived from the institutional structure, objectives and instruments for achieving these objectives that characterize the international organization concerned, combined with implied or explicit recognition by third states and/or other international organizations. A classic example of the first category is offered by the Treaties establishing the European Communities. According to the Article 281 EC, for example, "The Community shall have legal personality". This refers to international legal personality, as Article 282 EC explicitly bestows national legal personality on the EC.
